Will Activision Be Sued?

Nick Wagner aka Wagnificent is a Twitch streamer boosting over 51,000 Twitch followers. He’s been playing numerous games such as PUBG, Apex Legends and COD: Warzone. Way back in September, Wagnificent was banned by Activision during his live broadcast. The reason for the ban was that he was using EngineOwning cheat. He was banned together with the numerous waves of streamers who have said to be bringing this cheat into the game. His ban was removed when Wagnificent posted on twitter; “@ATVIAssist I just got falsely banned on WARZONE. Account name is Wagnificent! I’m deeply confused by this as I’m a streamer who likes thousands of viewers daily”. Multiple content creators such as Symfuhny and Clint Evans supported him.

Wagnificent was banned a second time by Activision. It was also during a live broadcast when he was stunned to find an error notification popping up during mid-game while he was playing COD: Modern Warfare. He tried to restart it but then another notification showed up which stated; Permanent Ban. Wagnificent was clearly frustrated at what happened. This time it seems as if Activision has handed out a shadow ban based on reports that it has received.

Wagnificent posted out again on twitter which is already deleted by now, he accused them that they are trying to kill his career. He also threatened Activision with legal proceedings and said that what they are doing amounts to defamation. He further criticized Activision’s cheat system and said that they should not be banning people based purely on ‘suspicious activity’ for which they have no real proof. Wagnificent stated, “I really can’t believe I have to sit around another two weeks in shadow ban till it gets uplifted because MWs report system and lack of true anti cheat. Reputation and channel growth at stake and it’s due to “suspicious” activity from in game reporting”
